Sandusky Motion for a New Trial Sandusky Motion for a New Trial The arguments presented for and against Sandusky’s motion for a new criminal trial is that his lawyers filed a suit that they were not given humble time to fully prepare for the proceeding that found Jerry Sandusky guilty of forty five counts. Secondly, Sandusky has completely denied that the charges leveled against him were true and that he was innocent therefore applied his right to appeal against his sentence. The judge would likely grant Sandusky grant of a new appeal because he enjoys the support of “National center for victims of crime action” who puts emphasis that his court proceedings should be done in fair, dignified and respectable manner.

Secondly, the judge would also likely grant him a new appeal as it his constitutional right in the state of Pennsylvania therefore giving authority to his defense team to do so within thirty after a verdict has been reached (Press, A. (2012, October 18). The defense and prosecuting attorneys are more likely to alter to the testimonies of their witnesses to as to gain favor with the judge and jury. This is because for both parties to stand a chance of winning the trial, they have to ensure that they win in their closing arguments.

Secondly, both parties will have to alter their opening statements to create weight in the theories they present to the court in the course of the verdict. I believe that in so doing, the verdict of the judge and jury may be altered as opening statements always give weight to the theories presented by both parties at the end of every cross examination, verdict and sentencing (Ohio & Ohio, 1885).ReferencesPress, A.
